Dear ***

Mr Hancock seeks an order on appeal terminating the entire claim. I obviously have a right to be heard on that, it being my claim issued 2 years ago. That requires sufficient time for my counsel to make the necessary arguments. Time ran out before Collins Rice and my counsel was told he needed to finish up to let the “court staff go home”, to the best of my recollection.

There are actually 4 issues, not two. There are two points of appeal, and two further points in the Respondent’s notice. These issues were not fully covered orally before Collins Rice as time ran out, which I believe may be why they are missing from the Judgment. My counsel and I consider given what happened at the last hearing, 1 day will not be enough, as Mr Hancock is likely to be most of that day (he has a 19 page skeleton argument). If it is listed for 1 day and time runs out and an adjournment is required, the prejudice will not be to Mr Hancock who goes first and obviously considers he will be less than a day, it will be to me. Surely better to list for 2 days and to go short than to list for 1 day and have to adjourn, bringing about even more delay.
