Special Counsel Jack Smith on Monday asked the Supreme Court to immediately step in to decide whether former President Donald Trump has immunity from prosecution for his actions seeking to overturn the 2020 election.
"This case presents a fundamental question at the heart of our democracy: whether a former President is absolutely immune from federal prosecution for crimes committed while in office," Smith wrote in the court filing.
Smith said it was "of imperative public importance" that the high court decide the question so that Trump trial, currently scheduled for March, can move forward as quickly as possible.

The U.S. Supreme Court on Wednesday agreed to decide whether a defendant arrested in connection with the Jan. 6, 2021, attack on the Capitol can be charged with obstructing an official proceeding in a dispute with potential implications for one of Republican former President Donald Trump's four criminal cases.
The justices took up an appeal by a Jan. 6 defendant after a federal appellate court allowed charges against him under a U.S. law that makes it a crime to obstruct or impede an official proceeding, based on accusations that he assaulted police as Congress met to certify Democrat Joe Biden's 2020 election victory over Trump.

Lives destroyed, people rotting in prison. All bc Bidenโs DOJ abused a post-Enron evidence tampering statute.
And what will Jack Smith do now? 2 of 4 counts in his indictment in jeopardy. This is potentially more impactful than immunity issue.
Will he drop the 1512c2-related counts? Will he seek a superseding indictment with other charges?
Trumpโs lawyers presumably will file a motion to dismiss those counts.

National Guard can be activated without โfederalizingโ the Election. Not to mention, NG played various roles in over 30 states for the 2020 Electionโ they even counted ballots.

First, SCOTUS agreed to review DOJ's use of 1512(c)(2), obstruction of an official proceeding, the most common J6 felony. It represents 2 of 4 counts in Smith's indictment against Trump.
Second, Judge Chutkan finally admitted all pretrial deadlines are now suspended as Trump's appeal of her motion denying presidential immunity makes its way through the process (hence, Smith's Hail Mary pass at SCOTUS this week.)
The March 4 trial date in Washington is essentially gone. And May 20 trial for classified docs case up in the air.
