Restoring respect for the law is our duty. After years of lawlessness under PiS, this is a difficult—at times painful—process that requires decisive action. There is no other way.

Judge of the Constitutional Tribunal

The longest-serving judge – acting in place of the President of the Constitutional Tribunal and directing the Constitutional Tribunal pursuant to Article 12(4), in conjunction with Article 11(2), of the Act on the Organisation and Procedure before the Constitutional Tribunal.

Acting pursuant to Article 12(4) of the Act of 30 November 2016 on the Organisation and Procedure before the Constitutional Tribunal (Journal of Laws of 2019, item 2393), hereinafter referred to as the "Act on the Organisation of the Constitutional Tribunal",

in my capacity as a judge of the Constitutional Tribunal acting in place of its President and directing the Constitutional Tribunal on account of having the longest period of service within the meaning of Article 11(2) of the Act on the Organisation of the Constitutional Tribunal, calculated continuously from 1 September 1995, i.e. from the commencement of my judicial apprenticeship, to the present day, pursuant to Article 130 §1 of the Act of 27 July 2001 – Law on the Organisation of Ordinary Courts (Journal of Laws of 2024, item 334, as amended), in conjunction with Article 10 §1 of the Act of 8 December 2017 on the Supreme Court (Journal of Laws of 2024, item 622, as amended), and in conjunction with Article 19 of the Act of 30 November 2016 on the Status of Judges of the Constitutional Tribunal (Journal of Laws of 2018, item 1422, as amended),

I hereby order:

The immediate suspension of Judge Bartłomiej Sochański from performing his duties as a judge of the Constitutional Tribunal, including the performance of his duties as Vice-President of the Constitutional Tribunal, for a period of one month.
