🚥በአዲስ በተሻሻለው የገጠር መሬት አዋጅ ቁጥር 310/2018 የተካተቱ ነጥቦች፦
▶️የአማራ ክልል መንግሥት የነበረውን አዋጅ ቁጥር 252/2009 በመሻር አዲሱን የገጠር መሬት አስተዳደርና አጠቃቀም አዋጅ ቁጥር 310/2018 በሥራ ላይ አውሏል።
🗂ይህ አዋጅ ከፌደራል የገጠር መሬት ሕግ (1324/2016) ጋር የተጣጣመ ሲሆን፣ ከመሬት ምዝገባ ጀምሮ እስከ ይዞታ ዝውውር፣ ከብድር ዋስትና እስከ መሬት ኪራይ እንዲሁም የባለይዞታዎችን መብትና ግዴታ በሚመለከቱ ጉዳዮች ላይ ሰፋ ያሉና መሠረታዊ ለውጦችን ይዟል።
🌟የባለይዞታዎችን መብት የሚያሰፉ 9 ዋና ዋና ነጥቦችን እንደሚከተለው በዝርዝር ቀርበዋል።
1. የአዋጁ ተፈጻሚነት ወሰን (Scope of Application) አንቀጽ 3 በቦታ ረገድ (Territorial Scope)፦
በገጠር መሬት ላይ፦ በክልሉ ውስጥ በሚገኝ ማንኛውም የገጠር መሬት ላይ ተፈጻሚ ይሆናል።
በከተማ አስተዳደሮች ሥር ባሉ የገጠር ቀበሌዎች፦ በከተማ አስተዳደር ሥር ቢሆኑም የገጠር ይዘት ባላቸውና በገጠር ቀበሌነት በተዋቀሩ አካባቢዎች ላይ ተፈጻሚ ይሆናል።
ርክክብ ባልተፈጸመባቸው የከተማ ወሰን መሬቶች፦ አንድ አካባቢ ወደ ከተማ ወሰን እንዲገባ ተደርጎ፣ ነገር ግን በከተማውና በገጠር መሬት አስተዳደር መካከል የይዞታ ርክክብ እስካልተፈጸመ ድረስ በዚህ አዋጅ መመራቱን ይቀጥላል።
በይዞታና ጉዳዮች ረገድ (Subject Matter Scope)፦
በሁሉም የይዞታ ዓይነቶች፦ በግል፣ በወል (በጋራ) እና በመንግሥት የገጠር መሬት ይዞታዎች ላይ ተፈጻሚ ይሆናል።
የሕግ ተቃርኖን ለመፍታት፦ የገጠርና የከተማ መሬት አስተዳደር ወሰን ላይ ይፈጠሩ የነበሩ ግራ መጋባቶችን ለመቅረፍ እንዲቻል፣ የገጠር መሬት ይዞታ ምን ማለት እንደሆነና የሚገኝበትን አስተዳደራዊ ወሰን በማያሻማ ሁኔታ ይገልጻል።
ልዩ ሁኔታዎች (Exceptions)፦
ልዩ ጥበቃ የሚደረላቸው መሬቶች፦ ለደን ልማት፣ ለዱር እንስሳት ጥበቃና ለማዕድን ልማት ተከልለው የተያዙ መሬቶችን በተመለከተ፣ አዋጁ እንደ አስፈላጊነቱ ተፈጻሚ ቢሆንም፣ በዘርፉ የወጡ ልዩ ሕጎች (Specific Laws) ቅድሚያ ሊሰጣቸው እንደሚችል ይጠቁማል።
2. የመሬት ማግኘት መብትና ተጠቃሚነት (አንቀጽ 4-8)
ነፃ መሬት፦ በግብርና መተዳደር የሚፈልግ የክልሉ ነዋሪ (ዕድሜው 18+) መሬት በነፃ የማግኘት መብት አለው።
ቅድሚያ የሚሰጣቸው፦ ወላጅ የሌላቸው ሕፃናት፣ አካል ጉዳተኞች፣ አቅመ ደካሞች፣ ሴቶችና ወጣቶች ልዩ ትኩረትና የቅድሚያ መብት ይሰጣቸዋል።
የመብት ቆይታ፦ የአርሶ አደሮች፣ ከፊል አርብቶ አደሮችና የሃይማኖት ተቋማት መብት የጊዜ ገደብ የሌለው (ለዘላለም) ነው። መንግሥታዊ ያልሆኑ ድርጅቶች ግን ለሥራቸው አስፈላጊ እስከሆነ ጊዜ ብቻ ይፈቀድላቸዋል።
3. የይዞታ ዝውውር (ኪራይ፣ ስጦታና ውርስ)
ኪራይ (አንቀጽ 9)፦ ባለይዞታው ከግማሽ የማይበልጥ ይዞታውን ማከራየት ይችላል። (አረጋውያንና አቅመ ደካሞች ግን ሙሉውን ማከራየት ይችላሉ)። የጊዜ ገደብ፦ ለቋሚ ተክል እስከ 30 ዓመት፣ ለሰብል እስከ 10 ዓመት።
ስጦታ (አንቀጽ 11)፦ ለሥጋ ዘመድ ወይም "በይጦረኛል" ውል ለማንኛውም ሰው በጽሑፍ መስጠት ይቻላል።
ውርስ (አንቀጽ 12)፦ ማንኛውም ሰው (የመንግሥት ሠራተኛን ጨምሮ) በኑዛዜ ወይም ያለኑዛዜ በፍትሐ ብሔር ሕጉ መሠረት መሬት መውረስ ይችላል። ይህም ቀደም ሲል የነበረውን ገደብ ያነሳ ትልቅ ለውጥ ነው።
4. ንብረት መሸጥና በጋራ ማልማት (አንቀጽ 13-19)
የንብረት ሽያጭ፦ በመሬት ላይ የለማን ቋሚ ንብረት (ቤት ወይም ቋሚ ተክል) መሸጥ ይቻላል። ቋሚ ተክል ከሆነ ሙሉ በሙሉ ከለማ ግማሹን፣ በከፊል ከለማ ግን የለማውን ማሳ መሸጥ ይፈቀዳል።
ከባለሀብት ጋር ማልማት፦ ባለይዞታው የመጠቀም መብቱን እንደ ካፒታል በመጠቀም ከባለሀብት ጋር በጋራ ማልማት ይችላል።
5. የብድር ዋስትና (አንቀጽ 15)
የመሬት የመጠቀም መብትን (Usufruct right) ለፋይናንስ ተቋማት ለብድር ዋስትና ማስያዝ ይቻላል።
የዋስትና ዘመኑ ቢበዛ እስከ 10 ዓመት ይቆያል። ተበዳሪው ካልከፈለ አበዳሪው መሬቱን ለተወሰነ ጊዜ በመጠቀም ዕዳውን ያስመክሳል።
6. ዲጂታል ምዝገባና የይዞታ ማረጋገጫ (አንቀጽ 61-62)
ዲጂታላይዜሽን፦ የመሬት መረጃ አስተዳደርና አገልግሎት አሰጣጥ በዲጂታል ሥርዓት መመራት እንዳለበት በአስገዳጅነት ተደንግጓል።
💳 የምስክር ወረቀት፦ የይዞታ ማረጋገጫ ደብተር በመሬት ላይ ያለን መብት የሚያረጋግጥ "የመጨረሻና ፍጹም" ማስረጃ ሆኖ ያገለግላል።
7. ይርጋና የግጭት አፈታት (አንቀጽ 14 እና 73)
የይዞታ ክስ ይርጋ፦ መሬት ያለአግባብ የተወሰደበት ሰው በ15 ዓመት ውስጥ ክስ ማቅረብ አለበት (ቀደም ሲል 10 ዓመት የነበረው መሻሻሉን ልብ ይሏል)።
የወርሻ ይርጋ፦ ውርሱ ከተከፈተ በ3 ዓመት ውስጥ መጠየቅ አለበት።
ሽምግልና፦ ባህላዊ የግጭት አፈታት ሥርዓቶችና ሽምግልና እንደ አማራጭ የመፍትሔ መንገድ እውቅና ተሰጥቷቸዋል።
8. የተጋላጭ ወገኖችና የአንድ በላይ ሚስት መብት (አንቀጽ 25)
አንድ ባል ከአንድ በላይ ሚስት በሚኖረው ጊዜ፣ የሴቶችን መብት ለመጠበቅ ሲባል የጋራ መሬቱ ተከፋፍሎ በየስማቸው እንዲመዘገብና ባልየው አዲስ በሚመሠርተው ትዳር ላይ በራሱ ድርሻ ላይ ብቻ እንዲመዘገብ ይደረጋል።
9. የአጠቃቀም ገደቦችና ግዴታዎች (አንቀጽ 33-35)
መሬትን የመንከባከብና የአፈር መሸርሸርን የመከላከል ግዴታ ተጥሏል።
ተዳፋትነቱ ከ60% በላይ የሆነ መሬት ለሰብል እርሻ መጠቀም የተከለከለ ሲሆን ለዛፍ ልማት ብቻ መዋል አለበት።
ግዴታን አለመወጣት ከማስጠንቀቂያ ጀምሮ የመጠቀም መብትን እስከ ማጣት የሚያደርስ አስተዳደራዊ እርምጃ ያስከትላል።

Job Description
We are looking for an experienced and skilled Painter Foreman to supervise and coordinate painting and finishing works at our construction project.
The successful candidate will be responsible for leading painting teams, ensuring quality workmanship, managing materials, and completing assigned works according to project schedules and specifications.
Key Responsibilities
Supervise and coordinate daily painting and finishing activities.
Assign tasks and monitor the performance of painters and helpers.
Ensure proper surface preparation, priming, painting, and finishing.
Ensure painting works comply with approved drawings, specifications, and quality standards.
Check color, coating, finishing quality, and workmanship.
Coordinate painting activities with other construction trades.
Monitor the proper use of paint, materials, tools, and equipment.
Minimize material wastage and report material requirements.
Monitor daily progress and ensure timely completion of assigned works.
Identify and correct defective or poor-quality painting works.
Ensure workers comply with site safety rules and use required PPE.
Report daily progress, manpower, material requirements, and site issues to the Site Engineer/Project Manager.
Qualification & ExperienceEducation: Level IV, Diploma, TVET, or equivalent qualification in Painting, Building Construction, Construction Finishing, or a related field.
Experience: Minimum 5 years of relevant experience, with at least 2 years of experience as a Painter Foreman or similar supervisory position.
Experience in building construction projects is highly preferred.
Good knowledge of surface preparation, primer, putty, emulsion, enamel, textured paint, and other finishing works.
Ability to read and understand basic construction drawings and specifications.
Strong leadership, communication, and team-management skills.
Ability to work under pressure and meet project deadlines.
