🌟ተፈጻሚነት አልባ መሆን Voidable Contract ማለትም በሕግ ፊት ተፈጻሚነት አልባ የሚሆን ውል(Voidable contract) ይሆናል፡- ሕጉ በሚያዘው መንገድና መስፈርት ሳይካሄድ የተሰጠ ውል በመሆኑ፣ ጉዳዩ በሚመለከተው አካል (ፍርድ ቤት ወይም የግዥ ተቆጣጣሪ ባለስልጣን) ሲታይ ውሉ እንዲፈርስ(Void) ይደረጋል። ውሉ ሕገ-ወጥ ከመሆኑ አንጻር ምንም አይነት የሕግ ከለላ አያገኝም። የድህረ ብቃት ማረጋገጫ ሳይካሄድ የተሰጠ ውል ህጋዊ መሰረት ስለሚጎድለው፣ ጉዳዩ የሚመለከተው አካል (ለምሳሌ ተወዳዳሪዎች ወይም የህግ አስከባሪ አካላት) ሲቃወሙት በህግ ፊት ውድቅ ሊደረግና የውል ስምምነቱም ሊፈርስ የሚችል (Voidable) ይሆናል።

🌟የአስተዳደር ጥፋት ተጠያቂነት ወይም የጥፋቱ ክብደት፡- ውሳኔውን የሰጡት የመንግስት ግዥ ፈጻሚ አካላት ወይም ኃላፊዎች የግዥና ንብረት አስተዳደር አዋጅን ሆን ብለው ወይም በቸልተኝነት በመተላለፋቸው ከባድ የአስተዳደር ቅጣት(እንደ ከሳራ መክፈል፣ ከሥራ መታገድ ወይም በወንጀል መጠየቅ) የሚያስከትል ጥፋት ፈጽመዋል ማለት ነው። ይህ ተግባር የመንግስትን ሀብት አደጋ ላይ የሚጥል፣ ሙስናን ሊጋብዝ የሚችል እና የግዥና ንብረት አስተዳደር አዋጅ መርሆች (ፍትሃዊነት፣ ግልፅነት እና ወጪ ቆጣቢነት) የሚጥስ በመሆኑ በፈጻሚው አካል ላይ አስተዳደራዊ እንዲሁም የወንጀል ተጠያቂነትን የሚያስከትል ከባድ ጥፋት ነው።

🌟አሰራሩን አላግባብ መጠቀም abuse of power:- የድህረ-ብቃት ግምገማ አስፈላጊነት ህጋዊነትን ማስጠበቅ ሲሆን ያለ ብቃት ማረጋገጫ የሚሰጥ ውል በመንግስት ግዥና ንብረት አስተዳደር አዋጅ መሰረት አሰራሩን አላግባብ መጠቀም (abuse of power) ተብሎ ይታወቃል።

🌟የሌሎች ተጫራቾች ወይም የሌሎች ዜጎች መብት:-የተጎዳው አካል(ሌላ ተጫራች ወይም የመንግስት አካል ወይም ማንኛውም ዜጋ) ጉዳዩን ለሚመለከተው አካል በማቅረብ ውሉ በህግ ፊት እንዲሰረዝ(Void) የማድረግ መብቱ የተጠበቀ ነው።

አዋጁን ተላልፈው ውሉን የሰጡ የመንግስት ሰራኞችና ኃላፊዎች በሙስናና በህግ መተላለፍ ተጠያቂ ይሆናሉ።
