But they can not make "saying that marriage is between a man and a woman" illegal.

This would be unconstitutional. Article 18 of the Polish constitution states: "Marriage, being a union of a man and a woman, as well as the family, motherhood and parenthood, shall be placed under the protection and care of the Republic of Poland"

In my opinion, this also clearly means that gay marriage is unconstitutional in Poland (rule of law bros please reply)
