Subject: Submission to the Joint Committee on Human Rights — Compulsory Digital Identity and Constitutional Compatibility


Dear Committee Clerk,

I wish to make a written submission for the Committee’s consideration regarding the human rights and constitutional implications of a compulsory Digital Identity scheme currently being discussed within Government.

I write as a British citizen, resident in Cornwall, with a deep respect for the principles that have guided this country’s legal order for centuries. My concern is that a universal, mandatory biometric register—by which every person must continually prove their identity to the state—would represent a profound departure from the constitutional presumption of liberty that underpins the English rule of law.

Our constitution has never required subjects to prove innocence by default. From Magna Carta (1215) through the Bill of Rights (1689) to the Human Rights Act (1998), the guiding assumption has been that freedom is the rule, and restraint the exception. A compulsory digital identity framework reverses this order, introducing a culture of verification rather than trust.

I ask the Committee to consider whether such a system would be compatible with:

1. Article 8 ECHR – protection of private life and informational autonomy;


2. Article 14 ECHR – non-discrimination, given digital exclusion of older, disabled and disadvantaged citizens;


3. The Equality Act 2010, particularly indirect discrimination under s.19;


4. The UK GDPR and Data Protection Act 2018, in respect of data minimisation, consent, and proportionality; and


5. The Protection of Freedoms Act 2012, enacted to prevent indiscriminate retention of biometric data.



The Committee may also wish to examine the wider implications of interoperability with international digital identity systems promoted by global institutions, and whether such integration could erode Parliament’s independent authority over the data and liberties of British citizens.

The issue is not technological convenience but constitutional continuity. Once the state assumes ownership of citizens’ biometric identifiers, the relationship between governed and governor subtly but decisively changes. I believe this would amount to a constitutional rupture—substituting administrative control for the presumption of liberty on which this country’s governance has long rested.

I therefore urge the Joint Committee to open a short inquiry or evidence session to examine whether any proposed Digital Identity Bill or related policy meets the standards of legality, necessity, and proportionality required by the Human Rights Act and the long traditions of the English constitution.

All scumbag companies going down this line (including Uber eats) need to know they will go in the TRASH for this

🇬🇧 Birmingham stood up against the digital ID system the corrupt treasonous government who are attempting to impose total control on the people. They have no power if we simply stand up, refuse to comply! This is the most important battle of our lifetime, we will not permit these mechanisms of control.

So many are united on this issue- we have a collective opportunity to destroy these corrupt governments once and for all. Stand with the people, stand on the right side of history.
