Sehr geehrte Damen und Herren,

hiermit widerspreche ich dem Anlegen einer elektronischen Patientenakte von meiner Person.

Das Bundesverfassungsrgericht hat eine Beschwerde und einen Eilantrag gegen Regelungen der elektronischen Patientenakte abgewiesen. Als Begründung wurde genannt, dass die Akte für Patienten freiwillig ist.

Das nehme ich zum Anlass, darauf hinzuweisen, dass ich keine elektronische Patientenakte haben möchte.

Zudem weise ich auf § 335 (3) SGB V in der Fassung vom PDSG hin:

„Die Versicherten dürfen nicht bevorzugt oder benachteiligt werden, weil sie einen Zugrif auf Daten in einer Anwednung nach § 334 (1) S. 2 bewirkt oder verweigert haben.“

Die von der Bundesreigierung vorgesehen Möglichkeit des Opt-out/Widerspruchs, nachdem die ePA angelegt wurde, findet in meinem Fall keine Anwendung, weil die Akte nicht angelegt werden darf.

Als Frist für eine die Erledigung bestätigende Rückantwort habe ich mir den 28.03.2023 vorgemerkt. Nach fruchtlosem Verstreichen der Frist behalte ich mir rechtliche Schritte vor.
