Gli attivisti affermano che le loro attività di monitoraggio sono aumentate a seguito dell'intensificarsi degli arresti effettuati dall'Immigration and Customs Enforcement nei tribunali dall'inizio del 2025.

Secondo il Guardian, il promemoria riassumeva le discussioni relative alla documentazione delle attività delle forze dell'ordine e all'ingresso nelle aule dei tribunali federali, ma non forniva alcuna prova a sostegno delle accuse di estremismo o violenza. Il #NYPD ha preso le distanze dal rapporto e l' #FBI ha rifiutato di rispondere a domande dettagliate. Il controllore della città di #New_York Brad Lander e i difensori delle libertà civili hanno condannato la sorveglianza come un'intimidazione volta a scoraggiare il controllo legale, paragonandola a casi storici di abuso di potere da parte dell'FBI.
