Republicans just got another bad decision from the United States Supreme Court, one that the Court System took forever to give, and then blamed it, in part, on no time left to implement a solution to our totally CORRUPT and out of control Mail-In voting “disaster,” which is a laughing stock all over the World, and where we are the only country that has to endure such a Nation Destroying SCAM. Justices Alito and Thomas, legends both, strongly disagreed with this horrible, highly political, ruling. It is a big loss for Republicans, and America itself, and makes cheating by the Radical Left “Dumocrats,” on Mail-In Ballots, a much easier thing to do - And now they have an open field to do so! The Supreme Court has really let our Country down! Certain Justices are petrified of these crazed and depraved Democrats, and are totally unable to show the courage necessary to save our America. Their horrible decision on Tariffs will be costing the U.S.A., for many years to come, Trillions and Trillions of Dollars. They didn’t even state, “money paid does not have to be paid back,” much to the benefit of entities that truly hate our Country, and have been RIPPING IT OFF FOR YEARS, unnecessarily costing us, immediately, Billions of Dollars. Likewise, the Supreme Court’s Decision on Birthright Citizenship is a complete and total disaster for America, and has already led to massive corruption with respect to “citizenship” in our Country. The damage done to America is incalculable, and they know this, just as everyone else does - It is an irreparable and unrecoverable harm! The Court’s inability and unwillingness to do the right thing for our Country will go down, in a very negative way, in the annals of History. This Supreme Court is bullied and cajoled by the Radical Left into making decisions that have set America back at least a hundred years. These are not the people I interviewed to serve on the United States Supreme Court, they are merely a shell of their original selves, a Court that is costing the United States Trillions of Dollars with shockingly bad rulings that are of such magnitude that it won’t be easily possible for our Country to recover or heal. It is a Court that will go down as having rendered some of the most destructive, hurtful, and damaging decisions in our Country’s history. It is not easy for me to write this criticism of the United States Supreme Court - it will likely cost me dearly for years to come - but I feel it my obligation and duty, as President, to do so for the America we love! Thank you for your attention to this very important matter. God bless the U.S.A. President DONALD J. TRUMP

If Congress remains deadlocked on comprehensive legislation like the CLARITY Act, the executive branch cannot create new statutory law out of thin air, but it can construct an aggressive, de facto federal regulatory regime using existing administrative levers, interagency coordination, and enforcement mechanisms.
1. Interagency Mobilization via Executive Order and FSOC
The White House directs agency coordination by issuing targeted Executive Orders and activating the Financial Stability Oversight Council (FSOC). Under Dodd-Frank Title VIII, FSOC holds the statutory authority to designate specific digital asset activities, clearing platforms, or stablecoin arrangements as "systemically important financial market utilities" (SIFMUs). This designation places them directly under Federal Reserve and prudential oversight without requiring new congressional authorization.
2. Coordinated Administrative Rulemaking (SEC and CFTC)
Rather than relying solely on ad-hoc litigation, the SEC and CFTC can formalize market operations through notice-and-comment rulemaking under the Administrative Procedure Act (APA):
Joint Jurisdictional Guidance: The two agencies can publish harmonized rules defining the boundary between "digital asset securities" and "digital commodities."
Conditional Exemptive Relief: Regulators can craft tailored safe-harbor pathways, allowing token issuers to register under simplified, modified disclosure requirements under existing Section 36 exemptive authority of the Exchange Act.
Custody and Clearing Mandates: Agencies can finalize strict asset-safeguarding rules, effectively barring commingling by requiring all registered intermediaries to custody assets with qualified, independent custodians.
3. Bank-Rail Ring-Fencing (Fed, OCC, and FDIC)
Prudential banking regulators can dictate crypto market conduct by controlling access to fiat rails:
Capital and Liquidity Surcharges: Enforcing punitive risk-weights and capital requirements on traditional banks holding crypto assets or providing custody services.
Master Account Gatekeeping: The Federal Reserve can deny or delay access to the Federal Reserve payment system for state-chartered crypto trust institutions, effectively forcing platforms to comply with federal standards to access liquidity.
4. Expanding National Security and FinCEN Mandates
The Treasury Department can expand Bank Secrecy Act (BSA) compliance via FinCEN rulemaking. By broadly defining "money transmitters" to encompass decentralized finance (DeFi) smart-contract deployers, wallet providers, and liquidity pools, the executive branch can unilaterally enforce stringent Anti-Money Laundering (AML) and Counter-Financing of Terrorism (CFT) requirements across the ecosystem.
5. Setting Precedent Through Consent Decrees
Agencies enforce compliance by leveraging settlements. When the SEC or CFTC settles with major exchanges, they embed structural operational mandates—such as mandatory audits, independent monitoring, and token-delisting protocols—into court-approved consent decrees, turning individual settlements into de facto industry-wide operating templates.
The Major Questions Constraint
Any unilateral administrative push faces severe judicial limits. Following the Supreme Court's curtailment of agency deference in Loper Bright and the application of the Major Questions Doctrine, sweeping rules that attempt to transform the statutory scope of the SEC or CFTC without explicit congressional authorization will face immediate federal court challenges and injunctions. The executive branch can restrict and enforce, but permanent market structure clarity ultimately requires Congress.
