Brazil is considering a ban on Telegram

Authorities in Brazil fear that the messenger could be used to send out mass disinformation ahead of elections scheduled for October.

The current head of the TSE (local analogue of the CEC), Luis Roberto Barroso, sent several letters to Pavel Durov, but did not receive a response. In these letters, the TSE proposed to hold a meeting with the Telegram administration and discuss possible measures aimed at ensuring the security of the upcoming elections. Similar arrangements already exist with Twitter, Facebook and WhatsApp.

Telegram has recently been gaining popularity among supporters of the country's current president, Jair Bolsonaro. In early 2021, he started a Telegram channel and even received a verification checkmark, and actively used the messenger during his election campaign in 2018.

Barroso has previously said that "no significant participant in the 2022 electoral process can work in Brazil without proper legal representation, which would be responsible for complying with national laws and judicial decisions." Thus, he hinted at the need to open a physical representation of such companies, including Telegram, in the country. Otherwise, he believes, their work in the country should be banned by legislators.

Blocking Telegram in Brazil

Brazil's Supreme Court judge has ruled to block Telegram in the country.

The messenger team ignored attempts by Brazil's Higher Electoral Court (TSE) to contact them. The judge ordered all Internet providers to block the work of Telegram. They face a fine of 100,000 reals ($20,000) for failure to comply with the court's decision.

On March 18, 2022, a Brazilian Supreme Court judge ruled to block Telegram in the country. That same night, Pavel Durov apologized to the court and asked to delay the ban of the messenger. Three days later, Brazil withdrew its decision to ban Telegram. Let's try to understand the current situation.

Immediately after first messages about the upcoming ban of Telegram in Brazil appeared, the messenger team sent an e-mail to the Brazilian court.

The letter states:
— Telegram blocked 14 channels at the request of the Brazilian court.
— Telegram blocked 19 channels containing similar information.
— In February 2022, Telegram blocked 3 more channels at the request of the court.
— Telegram's global search no longer returns results when searching for "allan dos santos" or similar terms.
— None of these Telegram channels received any monetization.
— The creators of the channels @allandossantos, @tercalivre and @artigo220 were accounts with addresses: @allansantosbr and @allandsantos (these usernames were sent in the block request).

What Telegram has promised to do in the future:
— ToS update.
— New features for reporting fake news.
— Permanent bans of channel owners for spreading misinformation.

The reason for restricting access to channels and individual posts was harsh criticism of the actions of the Supreme Court of Brazil.

If Telegram will ever receive a court order confirming you are suspected of terrorism, if the arguments of the court will be satisfying Telegram's requirements, it may disclose your IP address and phone number to the relevant intelligence agencies.

Brazilian court orders suspension of Telegram for not delivering data to police

On Wednesday, April 26, Brazilian courts ordered telecommunications providers and app stores to suspend access to and distribution of Telegram for failing to deliver data about groups on the platform suspected of planning and participating in school attacks to the Federal Police (PF). The measure must be immediately enforced.

Last Thursday, the Federal Court ordered Telegram to disclose data on the groups and individuals suspected of planning school attacks. The app had 24 hours to deliver the information to the PF "for security reasons". The app partially delivered the requested data on Friday, but had not yet revealed the phone numbers of participants.

The fine for not delivering the data has also increased from R$ 100,000 ($19.769) to R$ 1 million per day. So far, Telegram has not commented on the matter.
