Mohsen Eslamkhah, a 20-year-old resident of Bukan، West Azarbaijan province, and one of the individuals arrested in connection with the “Woman, Life, Freedom” protests, has been sentenced to death by Branch One of the Revolutionary Court of Mahabad on charges of “waging war against God” (Moharebeh).
According to information received, Eslamkhah was under the age of 18 at the time of the alleged acts and his participation in the protests. As such, his case falls within the scope of international legal standards concerning individuals who were under 18 at the time of the alleged offense. Reports indicate that in 2022, security forces repeatedly attempted to arrest him at his home.
Consequently, Eslamkhah reportedly left Iran and resided in the Iraqi Kurdistan for a period of time. After returning to Bukan in 2025, he was arrested. During his detention, he was reportedly subjected to pressure to provide forced confessions in connection with the charges against him. He was temporarily released after some time but was re-arrested in March 2026 and formally notified of the previously issued death sentence.
Two other defendants in the same case have also reportedly been sentenced to death by the same branch of the Revolutionary Court.
Given that Eslamkhah was under 18 at the time of the alleged offenses, the imposition and potential implementation of the death penalty in his case would constitute a violation of Iran’s international obligations, including the absolute prohibition on the use of the death penalty against individuals who were under 18 at the time of the alleged crime under international human rights law, including the Convention on the Rights of the Child.
