🇵🇸 Here Are Some of the War Crimes Committed by Israel So Far in Gaza | MintPress - October 2023

Let’s not mince words: Israel is committing Genocide, and that’s according to Article 6 of the Rome Statute of the International Criminal Court. Article 6 defines genocide as “causing serious bodily or mental harm to members of a group” or “deliberately inflicting conditions of life calculated to bring about [a group’s] physical destruction in whole or in part.” And Israeli leaders have not been shy about expressing their intent to destroy the people of Gaza.

🇵🇸 The Rome Statute established four core international crimes: genocide, crimes against humanity, war crimes, and the crime of aggression.

Those crimes "shall not be subject to any statute of limitations".[9] Under the Rome Statute, the ICC can only investigate and prosecute the four core international crimes in situations where states are "unable" or "unwilling" to do so themselves; the jurisdiction of the court is complementary to jurisdictions of domestic courts. The court has jurisdiction over crimes only if they are committed in the territory of a state party or if they are committed by a national of a state party; an exception to this rule is that the ICC may also have jurisdiction over crimes if its jurisdiction is authorized by the United Nations Security Council.

🇵🇸 Report / Israel: Starvation Used as Weapon of War in Gaza | HRW–

International humanitarian law, or the laws of war, prohibits the starvation of civilians as a method of warfare. The Rome Statute of the International Criminal Court provides that intentionally starving civilians by “depriving them of objects indispensable to their survival, including willfully impeding relief supplies” is a war crime. Criminal intent does not require the attacker’s admission but can also be inferred from the totality of the circumstances of the military campaign.

In addition, Israel’s continuing blockade of Gaza, as well as its more than 16-year closure, amounts to collective punishment of the civilian population, a war crime. As the occupying power in Gaza under the Fourth Geneva Convention, Israel has the duty to ensure that the civilian population gets food and medical supplies.
