ByteDance won't allow TikTok's algorithm to be part of a sale: Report

As the deadline for a forced sale or shutdown of the U.S. operations of the TikTok video-sharing app fast approaches, ByteDance is said to have decided its algorithm won't be part of any sale that happens.

September 15, the date by which U.S. President Donald Trump has ordered ByteDance to either sell TikTok to a U.S. company or see the service banned from the U.S. market, is looming. Today, September 13, The South China Morning Post is reporting (based on an unnamed source that the SCMP says was briefed on the Chinese company's boardroom discussions) that ByteDance has decided TikTok's algorithm won't be included as part of the sale.

So now the question is will a sale still happen by Tuesday? Will Microsoft and Walmart, Oracle -- with close ties to Trump -- and/or various TikTok investors still see enough value in TikTok to push forward with a purchase? And for how much?

Even before today's report about terms around the algorithm, there were questions whether a sale would happen at all. The Wall Street Journal reported on September 9 that ByteDance was discussing with the U.S. government various possible arrangements that would allow TikTok to avoid a full sale of its U.S. operations. And before that, the Chinese government had put in place steps designed to make a sale to a U.S. company more difficult, if not impossible.

The Pandemic's Digital Shadow

The pandemic is fueling digital repression worldwide.

The coronavirus pandemic is accelerating a dramatic decline in global internet freedom. For the 10th consecutive year, users have experienced an overall deterioration in their rights, and the phenomenon is contributing to a broader crisis for democracy worldwide.

In the COVID-19 era, connectivity is not a convenience, but a necessity. Virtually all human activities—commerce, education, health care, politics, socializing—seem to have moved online. But the digital world presents distinct challenges for human rights and democratic governance. State and nonstate actors in many countries are now exploiting opportunities created by the pandemic to shape online narratives, censor critical speech, and build new technological systems of social control.

Three notable trends punctuated an especially dismal year for internet freedom. First, political leaders used the pandemic as a pretext to limit access to information. Authorities often blocked independent news sites and arrested individuals on spurious charges of spreading false news. In many places, it was state officials and their zealous supporters who actually disseminated false and misleading information with the aim of drowning out accurate content, distracting the public from ineffective policy responses, and scapegoating certain ethnic and religious communities. Some states shut off connectivity for marginalized groups, extending and deepening existing digital divides. In short, governments around the world failed in their obligation to promote a vibrant and reliable online public sphere.

Apple Transparency Report: Government and Private Party Requests

Apple has released more iCloud content to authorities, end-to-end encryption is still missing.

User data was mainly sent to authorities in the U.S. and Brazil. In France, Sweden, Switzerland and the United Kingdom, Apple only transmitted iCloud data for one account request each, as the report lists. It remains unclear which of the partly sensitive data was transferred in detail and for what reason. In the new transparency report, Apple has confirmed for the first time that iCloud content may also be passed on in emergency requests from authorities - for example, to search for missing persons.

🇵🇸 Report / Israel: Starvation Used as Weapon of War in Gaza | HRW–

International humanitarian law, or the laws of war, prohibits the starvation of civilians as a method of warfare. The Rome Statute of the International Criminal Court provides that intentionally starving civilians by “depriving them of objects indispensable to their survival, including willfully impeding relief supplies” is a war crime. Criminal intent does not require the attacker’s admission but can also be inferred from the totality of the circumstances of the military campaign.

In addition, Israel’s continuing blockade of Gaza, as well as its more than 16-year closure, amounts to collective punishment of the civilian population, a war crime. As the occupying power in Gaza under the Fourth Geneva Convention, Israel has the duty to ensure that the civilian population gets food and medical supplies.

Meta’s content moderation policies and systems have increasingly silenced voices in support of Palestine on Instagram and Facebook in the wake of the hostilities between Israeli forces and Palestinian armed groups, Human Rights Watch said in a report released today.

The 51-page report, “Meta’s Broken Promises: Systemic Censorship of Palestine Content on Instagram and Facebook,” documents a pattern of undue removal and suppression of protected speech including peaceful expression in support of Palestine and public debate about Palestinian human rights.

Human Rights Watch found that the problem stems from flawed Meta policies and their inconsistent and erroneous implementation, overreliance on automated tools to moderate content, and undue government influence over content removals.
