Censorship of the Internet has been getting worse for years, but we just crossed a threshold which is going to take things to a whole new level. On August 25th, a new law known as the “Digital Services Act” went into effect in the European Union. Under this new law, European bureaucrats will be able to order big tech companies to censor any content that is considered to be “illegal”, “disinformation” or “hate speech”. That includes content that is posted by users outside of the European Union, because someone that lives in the European Union might see it. I wrote about this a few days ago, but I don’t think that people are really understanding the implications of this new law..

Every new car and van sold across the European Union will watch its driver from July 7, when an infrared camera aimed at the person behind the wheel becomes a legal condition of sale. The requirement reaches tens of millions of vehicles a year, and it arrives wrapped in the language of safety.
The rule goes by Advanced Driver Distraction Warning, or ADDW, and is inside the bloc’s General Safety Regulation, formally 2019/2144. Carmakers have had to fit it to new vehicle types since July 2024. From July 7, 2026, they must fit it to every new car and van that reaches the market.

Orwellian laws and the new “criminals”
Europe has accelerated down a path of regulation that treats speech itself as a danger to be managed by the State and its corporate enforcers. This is clearly reflected in the bloc’s supranational tools for speech suppression. The Digital Services Act (DSA) compels very large online platforms (VLOPs) to assess and mitigate “systemic risks” and platforms must act swiftly on notifications of illegal material or face fines up to 6% of global annual turnover. Though it claims to balance rights, the DSA’s risk-assessment mandates and enforcement mechanisms encourage over-compliance, leading to collateral censorship of lawful but controversial or unpopular speech.
That’s because the #DSA doesn’t just cover outright illegal content, hate speech, and threats to fundamental rights, but also "disinformation" and “any actual or foreseeable negative effects on civic discourse and electoral processes”. These are intentionally vague terms of course, as speech that has a “negative impact on public discourse” can literally be anything the establishment doesn’t like. Another “systemic risk” that the DSA compels platforms to screen for is content that can have “serious negative consequences to the person’s physical and mental well-being”. That could also literally mean anything, including just being offended by another person’s opinions.

That’s a busy period for the written word. And the number of those charged over the same period is 18,510, while 12,292 people were convicted.
The Big Brother Watch report, Britain’s Free Speech Problem: How Growing Restrictions Are Stifling Speech Online and Offline, covers the period between January 1, 2021, and December 31, 2025.
The laws are Section 1 of the Malicious Communications Act 1988, Section 127 of the Communications Act 2003, and Section 179 of the Online Safety Act 2023.
What do they concern? Indecent or grossly offensive messages, electronic communications that are grossly offensive, indecent, obscene, or menacing, as well as the persistent use of a public network intended to cause annoyance, inconvenience, or needless anxiety.
