Afghanistan: Two Legal Paths to Accountability for Gender-Based Persecution

The Taliban’s system of restrictions on women and girls in Afghanistan has prompted action through two distinct international legal pathways.

In July 2025, the International Criminal Court issued arrest warrants for Taliban Supreme Leader Haibatullah Akhundzada and Chief Justice Abdul Hakim Haqqani, finding reasonable grounds to believe that they bear criminal responsibility for the persecution of women and girls on gender grounds, among others.

Separately, Australia, Canada, Germany, and the Netherlands have initiated proceedings against Afghanistan under the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW), alleging widespread and systematic violations of women’s rights.

Neither proceeding is formally brought as a case of “gender apartheid.” The term is not currently recognized as a standalone crime under the Rome Statute.

Yet Afghanistan has become a central case in the growing international debate over whether and how gender apartheid should be recognized in international law.

از شهریور تا دی ۱۴۰۱، مرکز اسناد حقوق بشر ایران کشته‌شدن ۱۱۶ شهروند را در مناطق کردنشین ایران و ۱۵ شهروند کرد دیگر را در سایر نقاط کشور به‌طور مستقل راستی‌آزمایی کرد. ۱۳ نفر از کشته‌شدگان کودک بودند. ۱۲ نفر در حالی که هیچ تهدیدی ایجاد نمی‌کردند، از پشت سر هدف گلوله قرار گرفتند. ۳۰ نفر شبانه به خاک سپرده شدند و دست‌کم شش خانواده برای تحویل گرفتن پیکر عزیزانشان مجبور به پرداخت پول شدند. با وجود ادعاها درباره انجام تحقیقات، هیچ‌یک از این تحقیقات تاکنون نتایج خود را منتشر نکرده است.

Between September and December 2022, IHRDC verified the killing of 116 citizens in the Kurdish areas of Iran, and 15 more Kurdish citizens elsewhere in the country. Thirteen were children. Twelve were shot from behind while posing no threat. Thirty were buried at night, and at least six families had to pay to retrieve the body of their relative. No investigation has ever published its findings.

Case 07 — Hamid (pseudonym)

After 12 years of marriage, Hamid’s life became consumed by court proceedings and multiple episodes of imprisonment over a mehriyeh of 350 gold coins. Now separated from his wife, he has managed to pay only four of the 350 coins. “There are no winners in court,” he says. “Both sides lose.”

ده نفر. ده روایت واقعی. همه به دلیل بدهی به زندان افتاده‌اند؛ از وام‌های ساخت‌وساز و چک‌های برگشتی گرفته تا مهریه‌های پرداخت‌نشده، در چارچوب قوانینی که افراد را صرفاً به دلیل ناتوانی در پرداخت بدهی زندانی می‌کند.

پرونده ۰۷ — حمید (نام مستعار)

۱۲ سال زندگی مشترک او به سال‌ها رفت‌وآمد میان دادگاه و زندان بر سر مهریه ۳۵۰ سکه‌ای انجامید. حمید که شش سال است از همسرش جدا شده، در تمام این مدت تنها توانسته چهار سکه بپردازد. او می‌گوید: «دادگاه مسیری نیست که برنده داشته باشد؛ هر دو طرف بازنده‌اند.»

این ماه، مروری داریم بر اعتراض‌ها و سرکوب‌های سال‌های اخیر در ایران؛ الگوهای تکرارشونده سرکوب و پرونده‌هایی که با گذشت سال‌ها همچنان باز هستند.

چهار سال پیش، در ۸ مهر ۱۴۰۱، نیروهای امنیتی جمهوری اسلامی در زاهدان به سوی مردم تیراندازی کردند؛ هم به معترضان مقابل کلانتری ۱۶ و هم به نمازگزارانی که در مصلای بزرگ حضور داشتند.

در بعدازظهر آن روز، دست‌کم ۹۴ نفر کشته شدند؛ ۴۵ نفر از آنان در مصلای بزرگ جان باختند، جایی که هزاران نفر برای نماز حضور داشتند. ۱۵ نفر از قربانیان کودک بودند.

تا امروز، هیچ فرمانده یا آمر این کشتار پاسخگو نشده است. شکایت‌ها بایگانی شدند، خانواده‌ها تحت فشار قرار گرفتند و «تروریست‌ها» مسئول کشتار معرفی شدند.

در دی ۱۴۰۴، همان الگوهای سرکوب دوباره تکرار شد؛ این‌بار در مقیاسی بسیار بزرگ‌تر و در سراسر ایران.

جمعه خونین زاهدان را مرور می‌کنیم، چون این پرونده هیچ‌گاه بسته نشد.
