Iran: When Does Discrimination Become a System?

In Iran, gender-based inequality is embedded in law and reinforced by institutions that regulate women’s and girls’ family lives, movement, appearance, education, employment, and participation in public life. Then look at enforcement.

Compulsory hijab is not simply a rule on paper. Women and girls who challenge it have faced surveillance, arrest, detention, violence, prosecution, and other forms of coercion. And when women resist, gender-based restrictions can intersect with a broader machinery of repression, including arbitrary detention, torture, enforced disappearance, and other serious human rights violations.

This raises a deeper legal question: “Do discriminatory laws, state institutions, coercive enforcement, and repression operate together to create and maintain a system of gender-based domination?”

That is where the concept of gender apartheid becomes legally significant.

Gender apartheid is not currently recognized as a standalone crime under the Rome Statute. But CEDAW’s General Recommendation No. 40 calls for the codification of gender apartheid as a crime under international law, including through the Draft Crimes Against Humanity Convention currently under negotiation.

For Iran, the question is therefore not only whether discrimination exists. It is whether law, institutions, and coercive enforcement work together to sustain a system of gender-based domination—and whether international law is equipped to hold those responsible to account.

پرونده ۰۸ — برنا (نام مستعار)

برنا کارگر ساده ای بود که با وجود تایید اِعسار(ناتوانی مالی‌) برای پرداخت مهریه همسرش، سه سال را در زندان گذراند. از شدت نا امیدی دست به خودکشی زد و خود را از طبقه چهارم پایین انداخت و به سختی جان‌ به‌در برد؛ حالا سال‌هاست که فراری و در انزواست.

Case 08 — Borna (pseudonym)

Borna was a laborer who spent three years in prison despite being found unable to pay his wife’s mehriyeh. Overwhelmed by despair, he attempted suicide by jumping from the fourth floor and barely survived. He has since spent years living in hiding and isolation.

یاسمن باقری نویسنده‌ای ایرانی‌تبار، پناهنده‌ای سابق، کنشگر اجتماعی و دانشجوی حقوق و عدالت کیفری است که امروز در کرایست‌چرچ در نیوزیلند زندگی می‌کند.

زندگی یاسمن با تجربه آوارگی، مقاومت و تلاش برای بازپس‌گرفتن آینده‌اش شکل گرفته است. او در سال ۲۰۱۳، در سن پانزده‌سالگی، پس از تجربه آزار و اذیت‌های مذهبی و سیاسی، به همراه خانواده‌اش ایران را ترک کرد. خانواده برای یافتن امنیت به استرالیا رفتند و با قایق وارد این کشور شدند. با این حال، یاسمن بخش بزرگی از دوران نوجوانی خود را در بازداشتگاه‌های پناهجویان استرالیا گذراند. او در طول نزدیک به پنج سال، در جزیره کریسمس، داروین و سپس در چارچوب نظام بازداشت برون‌مرزی استرالیا در جزیره نائورو نگهداری شد.

این سال‌ها موانع بزرگی بر سر راه یاسمن و آرزوهای معمول یک دختر نوجوان قرار داد. آزادی، تحصیل و امکان برنامه‌ریزی برای آینده از او گرفته یا به‌شدت محدود شده بود. با این حال، در دوران حضورش در نائورو، به‌تدریج راه‌هایی برای رساندن صدایش به بیرون پیدا کرد. او با روزنامه‌نگاران و کنشگران خارج از جزیره در ارتباط بود، از زندگی در بازداشت می‌نوشت و تجربه‌های خود و دیگران را با آنان در میان می‌گذاشت. در همین دوران، نوشتن و شعر برای او به راهی برای بیان خود، حفظ هویت و مقاومت تبدیل شد.

در سال ۲۰۱۸، یاسمن به دلایل پزشکی از نائورو به استرالیا منتقل شد. نوشته‌های او بعدها در پروژه‌های ادبی و فعالیت‌های حمایتی مورد استفاده قرار گرفت؛ پروژه‌هایی که به دنبال بازتاب دادن تجربه‌های پناهندگان، زنان و افرادی بودند که زندگی‌شان تحت تأثیر آوارگی و جابه‌جایی اجباری قرار گرفته است.

امروز، یاسمن در حال ساختن دوباره فرصت‌هایی است که در دوران نوجوانی از او گرفته شده بود. او در رشته حقوق و عدالت کیفری تحصیل می‌کند و در کرایست‌چرچ به‌عنوان تسهیلگر عدالت ترمیمی فعالیت دارد. همچنین به‌عنوان مربی جوانان، در زمینه حمایت از پناهندگان و جوامع قومی فعالیت می‌کند، در برنامه‌هایی برای تقویت مشارکت پناهندگان حضور دارد و در امور اجتماعی و جامعه‌محور نیز نقش فعالی ایفا می‌کند.

مسیر زندگی یاسمن، از ترک اجباری ایران در نوجوانی و سال‌های بازداشت برون‌مرزی تا تحصیل حقوق و کمک به دیگران برای یافتن مسیرشان در نظام عدالت، بازتاب‌دهنده باور عمیق او به مقاومت، کرامت انسانی و توانایی زنان و دختران برای ساختن آینده خود است.

Yasaman Bagheri is an Iranian-born writer, former refugee, community advocate and Law and Criminal Justice student based in Ōtautahi Christchurch, New Zealand.

Yasaman’s journey has been shaped by displacement, resistance and a determination to reclaim her future. In 2013, at the age of 15, she left Iran with her family after experiencing religious and political persecution. Seeking safety in Australia, they arrived by boat, but Yasaman then spent much of her adolescence within Australia’s detention system. Over approximately five years, she was held across Christmas Island, Darwin and the offshore detention regime on Nauru.

Those years placed enormous barriers between Yasaman and the ordinary ambitions of a teenage girl. Her freedom, education and ability to plan for her future were restricted. During her time on Nauru, she began finding ways to make her voice heard. She communicated with journalists and advocates outside the island, shared accounts of life inside detention, and began using writing and poetry as forms of expression and resistance.

In 2018, Yasaman was medically evacuated from Nauru to Australia. Her writing later became part of literary and advocacy projects amplifying the experiences of refugees, women and people affected by forced displacement.

Today, Yasaman is rebuilding the opportunities that were interrupted during her adolescence. She studies Law and Criminal Justice and works as a restorative justice facilitator in Christchurch. She is involved in refugee and ethnic community advocacy as a youth leader and mentor, participates in initiatives supporting meaningful refugee participation, and serves in community governance.

Her journey from a teenage girl forced to leave Iran, through offshore detention, to studying law and helping others navigate systems of justice reflects a continuing belief in resistance, dignity and the ability of women and girls to shape their own futures.

پرونده ۰۹ — بهرام (نام مستعار)

ده سال پس از طلاق، خطر زندان هنوز بر زندگی بهرام سایه انداخته بود. خانواده‌اش با پرداخت پنج سکه، زمینهٔ آزادی او را پس از هفت ماه حبس در اوین فراهم کردند؛ اما هزینه‌های زندگی و تولد فرزندش، پرداخت اقساط را از توانش خارج کرد. در زمان ثبت این روایت، ۱۱ سکه بدهیِ عقب‌افتاده داشت و از ترس بازداشت دوباره، پنهانی زندگی می‌کرد.

Case 09 — Bahram (pseudonym)

Ten years after his divorce, the threat of imprisonment still hung over Bahram’s life. His family paid five gold coins to secure his release after seven months in Evin Prison, but living expenses and the birth of his child left him unable to keep up with the installments. At the time this testimony was recorded, he was 11 gold coins behind on his payments and living in hiding for fear of being arrested again.

مژده هاشمی بازرگانی، شهروند ساکن الوند قزوین، پس از بیش از پنج ماه بازداشت، همچنان در زندان مرکزی قزوین به‌سر می‌برد و گزارش‌ها از تأیید حکم اعدام او در دیوان عالی کشور حکایت دارد.

هاشمی بازرگانی از ۱۵ فروردین ۱۴۰۵ بازداشت شده و بر اساس گزارش‌های منتشرشده، با اتهاماتی از جمله «جاسوسی»، «همکاری با اسرائیل و آمریکا» و «توهین به رهبری» روبه‌رو است. او اتهامات مطرح‌شده علیه خود را رد کرده است.

در جریان رسیدگی به پرونده، گزارش‌هایی درباره ضرب‌وشتم، فشار در دوران بازجویی و اخذ اعترافات اجباری علیه او منتشر شده است. همچنین گفته شده بخشی از تصاویر و اعترافات منتسب به این شهروند از شبکه استانی قزوین پخش شده است.

او پیش‌تر با اعتراض به نحوه بازداشت و بازجویی، خواستار بررسی آثار آسیب‌های جسمی و ثبت آن‌ها توسط پزشکی قانونی شده بود.

اکنون انتشار گزارش‌هایی درباره تأیید حکم اعدام در دیوان عالی کشور، نگرانی‌ها درباره احتمال اجرای حکم را افزایش داده است. با این حال، وضعیت نهایی پرونده و جزئیات مربوط به حکم نیازمند اعلام رسمی مراجع قضایی است.

در صورت تأیید نهایی حکم، مژده هاشمی بازرگانی در معرض خطر اجرای اعدام قرار خواهد گرفت؛ موضوعی که همزمان با مطرح بودن ادعاهایی درباره روند بازجویی و نحوه اخذ اعترافات، نگرانی‌هایی درباره رعایت حقوق او در روند دادرسی ایجاد کرده است.

رشید حسامی، معلم و فعال مدنی اهل قروه که در بازداشت به‌سر می‌برد، بنا بر گزارش منابع مطلع، با وخامت وضعیت جسمانی مواجه شده است.

بر اساس این گزارش‌ها، حسامی پس از انتقال به بازداشتگاه اطلاعات سپاه قروه و در پی فشارهای شدید جسمی، بیهوش شده و پس از افت علائم حیاتی به یکی از بیمارستان‌های سنندج منتقل شده است.

منابع نزدیک به خانواده همچنین از محرومیت او از دسترسی به داروهای ضروری و ممانعت از تماس و ملاقات خانواده با وی خبر داده‌اند.
همچنین مقام‌های قضایی و امنیتی تاکنون توضیح رسمی درباره شکنجه و وضعیت جسمانی وضعیت فعلی و محل نگهداری او ارائه نکرده‌اند.

با توجه به نگرانی‌ها درباره سلامت این معلم، خانواده و نزدیکان رشید حسامی خواستار اطلاع‌رسانی شفاف درباره وضعیت پزشکی، محل نگهداری و روند رسیدگی به پرونده او هستند.

Iran is confronting one of the most difficult periods in its recent history. Following the massacre of protesters in January 2026, one round of armed conflict in 2025, and the war that began in February 2026, the country has faced prolonged internet shutdowns, severe economic disruption, high inflation, currency depreciation, and growing difficulties accessing basic necessities.

Children are among those most vulnerable to these consequences.

Over the past year, schools have repeatedly been closed or moved online amid protests, insecurity, and war. Yet for months, Iran also experienced a near-total internet shutdown. Although authorities relied on domestic platforms to continue education, these services were often unavailable or unreliable. For millions of children, weeks and months passed without meaningful access to school.

For children without reliable internet, devices, or adequate learning conditions at home, “online education” was not an equivalent substitute for the classroom. It was exclusion from education.

The economic crisis has added another burden. As schools reopen, many families are struggling to afford books, supplies, transportation, clothing, and other necessities—at a time when some are already struggling to secure adequate food and nutrition.

Article 30 of Iran’s Constitution requires the government to provide free education through secondary school. Yet the reality facing many families is very different.

The Iranian state has a responsibility to protect the lives, well-being, education, and development of children living under its authority—during times of crisis as well as in times of stability.

Children did not create Iran’s political conflicts, wars, economic crisis, or uncertainty. But they are living with the consequences.

Their losses today will shape Iran’s future tomorrow.

Mohsen Rashidi Khaniabadi was among those killed during the January 2026 crackdown in Iran. His sister, Roya Rashidi Khaniabadi, spoke about him and the families’ pursuit of justice at an Iran Human Rights Documentation Center side event during the 63rd session of the UN Human Rights Council in Geneva.

Roya said that after 10 years and three months apart, she never had the chance to embrace her brother again, hear his voice, or ask what happened on the night he was killed. She spoke as the voice of Mohsen and other families seeking justice.

She demanded the truth about who fired, who gave the orders, who was responsible for transporting the wounded, and why families were kept in the dark. She urged the UN to preserve evidence, support independent and impartial investigations, hold those responsible accountable, and speak for prisoners and people facing execution: “We want answers. We want justice.”

Roya vowed that their call for justice would not be silenced until the truth was established and justice delivered, and that the names of Mohsen and others killed would live on: “You are not here, but your voice is here, and we are still standing.”

محسن رشیدی خانی‌آبادی از جان‌باختگان سرکوب ژانویه ۲۰۲۶ در ایران بود. رویا رشیدی خانی‌آبادی، خواهر او، در نشست جانبی مرکز اسناد حقوق بشر ایران در شصت‌وسومین اجلاس شورای حقوق بشر سازمان ملل در ژنو، درباره برادرش و دادخواهی خانواده‌های جان‌باختگان سخن گفت.

رویا گفت پس از ۱۰ سال و سه ماه دوری، دیگر نتوانست برادرش را در آغوش بگیرد، صدایش را بشنود یا از او بپرسد در شب جان‌باختنش چه گذشت. او خود را صدای محسن و دیگر خانواده‌های دادخواه دانست.

او خواستار روشن‌شدن حقیقت درباره تیراندازی، آمران سرکوب، انتقال مجروحان و بی‌خبری خانواده‌ها شد و از سازمان ملل خواست شواهد را حفظ کند، تحقیقات مستقل و بی‌طرفانه انجام شود و آمران و عاملان پاسخ‌گو شوند. او همچنین از این نهاد خواست صدای زندانیان و افراد در معرض اعدام باشد: «ما پاسخ می‌خواهیم. ما عدالت می‌خواهیم.»

رویا تأکید کرد تا روشن‌شدن حقیقت و اجرای عدالت، صدای دادخواهی خاموش نخواهد شد و نام محسن و دیگر جان‌باختگان زنده خواهد ماند: «اینجا نیستید، اما صدایت اینجاست و ما هنوز ایستاده‌ایم.»

یک ادعا چگونه در شبکه‌های اجتماعی شکل می‌گیرد، بازنشر می‌شود و به یک «روایت» تبدیل می‌شود؟

مرکز اسناد حقوق بشر ایران در پژوهشی درباره اطلاعات نادرست و گمراه‌کننده پیرامون اعتراضات دی ۱۴۰۴، سه نمونه را بررسی کرده است:

• ادعاهایی درباره کشته‌شدن یک کودک ۸ ساله در اصفهان

• تفاوت میان آمار رسمی و شمارش‌های مستقل قربانیان

• نسبت‌دادن خشونت‌ها و معترضان به «موساد»

این پژوهش با بررسی زمان انتشار، بازنشر محتوا، حساب‌های منتشرکننده و تغییرات روایت‌ها نشان می‌دهد که چگونه یک ادعا می‌تواند در فاصله‌ای کوتاه، از یک پست به روایتی گسترده تبدیل شود.

شش الگوی مشترک در این سه پرونده:

قطعیت پیش از تحقیق، تکرار یک روایت چندمنبعی، انتساب به «دشمن خارجی» بدون سند، دسته‌بندی قربانیان، انتقال بار اثبات به قربانیان و دوگانه‌سازی برای عادی‌سازی.

تنها یک هفته از عروسی علی گذشته بود که ابلاغ مطالبهٔ مهریه به دستش رسید؛ به گفتهٔ او، همسرش پیش از عروسی برای دریافت مهریه اقدام کرده بود. آغاز زندگی مشترک برای او با سال‌ها درگیری در ده‌ها پروندهٔ قضایی گره خورد؛ حساب‌هایش مسدود شد و ممنوعیت خروج از کشور، فرصت استفاده از بورسیهٔ تحصیلی‌اش را از او گرفت.

Case 10 — Ali (pseudonym)

Just one week after his wedding, Ali received notice of his wife’s claim for mehriyeh, which he says she had initiated before the wedding. The start of their married life marked the beginning of years of legal battles involving dozens of court cases. His bank accounts were frozen, and a travel ban prevented him from taking up his scholarship.

ستایش گلشنی تنها سه سال داشت که آزار و سرکوب، خانواده‌اش را مجبور به ترک ایران کرد. یک سال بعد، همراه پدر و مادرش با کشتی به استرالیا رسید و به مرکز رسیدگی به درخواست‌های پناهندگی درجزیره نائورو منتقل شد.

ستایش بیش از دو سال در بازداشت بود؛ سال‌هایی که خاطراتشان هنوز با اوست. اما با تکواندو راهی برای ادامه دادن و ساختن زندگی خودش پیدا کرد.

تکواندو برای ستایش فقط یک رشته ورزشی نبود. به پناهگاهی تبدیل شد که در آن می‌توانست تمرکز کند، رقابت کند و به آینده فکر کند. تا شانزده‌سالگی، او به ورزشکاری حرفه ای با افتخارات و جوایز متعدد تبدیل شده بود.

با این حال، بلاتکلیفی همچنان بخشی از زندگی اوست. وضعیت مهاجرتی‌اش فرصت‌هایش را برای تحصیل، شرکت در مسابقات بین‌المللی و ساختن آینده‌ای امن در استرالیا محدود کرده است. با وجود آنکه در سال ۲۰۱۹ به عنوان پناهنده شناخته شد، آینده اقامتش همچنان نامشخص است.

ستایش می‌خواهد در استرالیا بماند؛ جایی که در آن بزرگ شده و زندگی‌اش را ساخته است. او در عین حال از بازگشت به ایران هراس دارد و می‌گوید ممکن است به عنوان یک زن جوان بی اعتقاد به اسلام با خطر آزار و سرکوب روبه‌رو شود.

داستان ستایش، روایت دختری است که از کودکی با چالش‌هایی بزرگ روبه‌رو شده، اما هرگز اجازه نداده گذشته‌اش آینده او را تعیین کند. او در تکواندو قدرتش را پیدا کرده، هدفش را ساخته و صدایش را پیدا کرده است.

حالا ستایش فقط یک فرصت می‌خواهد؛ فرصتی برای ساختن آینده‌ای که سال‌ها برای آن تلاش کرده و هنوز برای به دست آوردنش می‌جنگد.
