Case 09 — Bahram (pseudonym)

Ten years after his divorce, the threat of imprisonment still hung over Bahram’s life. His family paid five gold coins to secure his release after seven months in Evin Prison, but living expenses and the birth of his child left him unable to keep up with the installments. At the time this testimony was recorded, he was 11 gold coins behind on his payments and living in hiding for fear of being arrested again.

Iran is confronting one of the most difficult periods in its recent history. Following the massacre of protesters in January 2026, one round of armed conflict in 2025, and the war that began in February 2026, the country has faced prolonged internet shutdowns, severe economic disruption, high inflation, currency depreciation, and growing difficulties accessing basic necessities.

Children are among those most vulnerable to these consequences.

Over the past year, schools have repeatedly been closed or moved online amid protests, insecurity, and war. Yet for months, Iran also experienced a near-total internet shutdown. Although authorities relied on domestic platforms to continue education, these services were often unavailable or unreliable. For millions of children, weeks and months passed without meaningful access to school.

For children without reliable internet, devices, or adequate learning conditions at home, “online education” was not an equivalent substitute for the classroom. It was exclusion from education.

The economic crisis has added another burden. As schools reopen, many families are struggling to afford books, supplies, transportation, clothing, and other necessities—at a time when some are already struggling to secure adequate food and nutrition.

Article 30 of Iran’s Constitution requires the government to provide free education through secondary school. Yet the reality facing many families is very different.

The Iranian state has a responsibility to protect the lives, well-being, education, and development of children living under its authority—during times of crisis as well as in times of stability.

Children did not create Iran’s political conflicts, wars, economic crisis, or uncertainty. But they are living with the consequences.

Their losses today will shape Iran’s future tomorrow.

Mohsen Rashidi Khaniabadi was among those killed during the January 2026 crackdown in Iran. His sister, Roya Rashidi Khaniabadi, spoke about him and the families’ pursuit of justice at an Iran Human Rights Documentation Center side event during the 63rd session of the UN Human Rights Council in Geneva.

Roya said that after 10 years and three months apart, she never had the chance to embrace her brother again, hear his voice, or ask what happened on the night he was killed. She spoke as the voice of Mohsen and other families seeking justice.

She demanded the truth about who fired, who gave the orders, who was responsible for transporting the wounded, and why families were kept in the dark. She urged the UN to preserve evidence, support independent and impartial investigations, hold those responsible accountable, and speak for prisoners and people facing execution: “We want answers. We want justice.”

Roya vowed that their call for justice would not be silenced until the truth was established and justice delivered, and that the names of Mohsen and others killed would live on: “You are not here, but your voice is here, and we are still standing.”

Setayesh Golshani was three years old when persecution forced her family to leave Iran. A year later, she arrived in Australia with her parents by ship and was transferred to the offshore asylum processing centre on Nauru.

She spent more than two years in detention before being released into community detention in Brisbane.

As she grew older, Setayesh found strength through taekwondo. The sport became her refuge — a place where she could focus, compete and begin to imagine a future of her own. By sixteen, she had become a multi-award-winning athlete.

But the uncertainty of her childhood continues to shape her life. Her immigration status limits her opportunities to compete internationally, study and build a secure future in Australia. Although she was recognized as a refugee in 2019, her status remains unresolved.

Setayesh continues to advocate for the chance to remain in Australia, where she has grown up and built her life. She also fears returning to Iran, where she says she could face persecution as a young woman and apostate.

Her journey is one of a girl who has faced extraordinary challenges and refused to let them define her. Through taekwondo, she has found strength, purpose and a voice of her own.

Now, she is fighting for the opportunity to turn that hard-won strength into a future.

Mahboubeh Shabani, a prisoner sentenced to death at Vakilabad Prison in Mashhad, was forcibly transferred from Aramesh Ward to solitary confinement on Monday, September 28, 2026. HRANA reported the transfer.

That day, Sepideh Gholian, an activist and former political prisoner, wrote in a post on X that prison guards had told Shabani: “Because Trump has supported you, we will execute you.” Gholian also reported that the phones in Aramesh Ward had been confiscated. She described the prisoners as living in intense fear and anxiety and said the measure might extend to other security wards.

In a voice message released from prison before her transfer to solitary confinement, Shabani said that her death sentence had been communicated to her lawyer. She warned of the danger facing political prisoners sentenced to death and appealed to the public and human rights organizations for help.

Shabani, a 30-year-old civil engineer, was arrested in Mashhad on February 2, 2026. Reports have linked her case to transporting injured protesters to hospital on her personal motorcycle during the January protests. After spending a prolonged period in solitary confinement, she was transferred to the women’s ward. Branch One of the Mashhad Revolutionary Court, presided over by Gholamreza Akbari Moghadam, sentenced her to death on the charge of “operational action to strengthen Israel, the United States, and affiliated opposition groups.”

September 29, 2026 — The Iran Human Rights Documentation Center (IHRDC) today released “Punishing Poverty: Debtor Imprisonment in the Islamic Republic of Iran and the Urgent Case for Legal Reform.” Under Article 3 of the Law on the Enforcement of Financial Judgments, a person unable to pay a debt may be imprisoned at the creditor’s request, with no fixed maximum term. Official statistics show that more than 10,000 people were held on an average day in 2022–23 for civil financial judgments alone—roughly one in every 23 prisoners in the country.

This practice contravenes Article 11 of the International Covenant on Civil and Political Rights, which prohibits imprisonment merely on the ground of inability to fulfill a contractual obligation. The report’s release follows the Guardian Council’s return to Parliament of a bill that would lower the detention-backed ceiling on marital financial obligations (mehriyeh), a piecemeal measure that, according to the report, leaves the system’s structural flaws unaddressed.

IHRDC calls on the Iranian authorities to abolish imprisonment for mere inability to pay and replace it with enforcement against assets, installment plans based on actual ability to pay, and effective protections for women’s financial entitlements.

Hengameh Sharifinia, Foad Abdolghaffari, and Fahim Agahi have been sentenced to prison. The ruling also orders the confiscation of their property and imposes restrictions on travel abroad and participation in groups and associations.

According to HRANA, the sentences were issued in September 2026 by Branch 15 of the Tehran Revolutionary Court, presided over by Judge Abolghasem Salavati. Sharifinia received 10 years in prison on a charge of engaging in deviant educational or proselytizing activity contrary to or undermining Islamic law, and five years on a charge of membership in groups allegedly aimed at undermining national security. She was also deprived of social rights for 10 years.

Abdolghaffari and Agahi were each sentenced to five years in prison on a charge of proselytizing activity deemed contrary to Islamic law and a further five years on a charge of membership in groups allegedly aimed at undermining national security. Each was also fined 80 million toumans (approximately $320).

All three citizens were also banned from leaving the country and from participating in groups and associations for two years. Sharifinia and Agahi were arrested in Tehran in October 2025, while the homes of several Baha’i citizens were searched. Abdolghaffari was arrested during the same period while his home in Tehran was being searched.

Nilofar Ayoubi is an Afghan women’s and human rights defender, journalist, entrepreneur, humanitarian advocate, and international speaker whose life reflects a lifelong commitment to freedom, equality, and women’s voices.

Growing up in conservative northern Afghanistan, Nilofar spent much of her childhood as bacha posh—a social phenomenon in which girls are raised and presented as boys, often for different reasons, including families without sons or without a male breadwinner. In Nilofar’s case, however, she became bacha posh simply because she wanted to experience the freedom and opportunities of a normal childhood—freedoms that were largely unavailable to girls around her. Under the name Zmaray, meaning “lion” in Pashto, she could move more freely, feel safer, and continue her education.

Living as a boy from an early age gave Nilofar firsthand experience of the stark differences between the freedoms afforded to boys and the restrictions placed on girls. That experience shaped her determination to create a society where girls would not have to hide who they are in order to access basic rights and opportunities.

She went on to become a journalist and entrepreneur, creating employment opportunities for many women, founding the Women’s Political Participation Network, and co-founding the #WhereIsMyName campaign. Her humanitarian work has included supporting hundreds of Afghan families during COVID-19 and helping relocate more than 200 people at high risk of persecution following the Taliban’s return to power.

After leaving Afghanistan in 2021, Nilofar continued her advocacy from exile, speaking internationally about Afghan women’s rights, democracy, independent media, and freedom. She has served as the CEO of Asia Times Afghanistan and is the co-founder of Radio Free Women, amplifying the voices of women increasingly excluded from public life.

Ali Hemati Sistani and Majid Nikandish, two protesters detained during the January 2026 protests in Mashhad, were executed on Wednesday, September 30, 2026. Mizan News Agency, which is affiliated with the Islamic Republic’s judiciary, announced that their executions were carried out after their death sentences were upheld by the Supreme Court.

The two men were arrested in connection with protests held on January 8 and 9 in Mashhad’s Tabarsi district. The judiciary described them as organizers of the protests and alleged that they were involved in events that resulted in the deaths of four security personnel. These allegations have not been independently verified.

According to Iran Human Rights, Branch 1 of the Mashhad Revolutionary Court sentenced Hemati Sistani and Nikandish to death, and Branch 39 of the Supreme Court upheld their sentences. Mizan did not specify the exact charges on which the death sentences were based.

Mizan also claimed that the two men confessed during interrogation to the acts attributed to them and that their trials were held in the presence of lawyers. However, no independent information has been made available about the circumstances of their interrogations, how the statements attributed to them were obtained, or whether they had access to lawyers of their own choosing.

The lack of transparency surrounding the judicial proceedings and interrogation process, particularly in cases resulting in executions, raises serious concerns about violations of the right to a fair trial and the right to life.
